Egg Donation in Albania: Legal Framework & What You Should Know

April 8, 2025 7 min read HealthFirst IVF Editorial

Egg donation is one of the most common routes to parenthood for women with diminished ovarian reserve, premature ovarian insufficiency, recurrent IVF failure, or genetic conditions they do not wish to pass on. Albania has developed a clear, supportive legal framework for egg donation — one of the key reasons it has become a preferred destination for international fertility patients.

Is Egg Donation Legal in Albania?

Yes. Egg donation is fully legal in Albania and is regulated under Albanian law on assisted reproduction. Both anonymous and known egg donation are permitted. The law provides protections for donors, recipients and any children born as a result of donation.

"Albania's regulatory framework strikes a balance between protecting donor anonymity, safeguarding recipient rights, and ensuring the welfare of donor-conceived children." — HealthFirst IVF Legal Team

Anonymous vs. Known Donation

Anonymous donation is the most common arrangement in Albania. The donor's identity is not disclosed to the recipient or the child. However, in line with evolving European standards, limited non-identifying information (physical characteristics, health history) is typically shared.

Known donation — where a friend or family member donates — is also legally permitted with appropriate medical and psychological screening of the donor.

Who Are the Donors?

All egg donors in our partner clinic network undergo rigorous screening before being approved. This includes:

Matching process: Donors are matched to recipients based on physical characteristics (eye colour, hair colour, height, build, skin tone) and blood type. Extended matching by education level, personality profile or nationality is available on request.

Legal Rights of Recipients

Under Albanian law, the intended mother (recipient) is the legal mother of any child born from a donor egg cycle. No legal adoption or additional process is required. The birth certificate will list the birth mother as the legal parent.

For international patients, it is important to understand how your home country treats donor-conceived children. Most EU countries now recognise maternity by birth, meaning the woman who carries and delivers the child is the legal mother — regardless of the egg source. We recommend consulting a family law specialist in your country of residence before beginning treatment.

Contracts & Consent

All egg donation arrangements involve legally binding consent and agreement documentation, handled by our partner legal team in Tirana. Agreements cover:

Financial Compensation for Donors

Albanian law permits "reasonable compensation" for egg donors to cover time, inconvenience and medical risk. This is not payment for eggs themselves — donation is altruistic in principle — but compensation for the donation process. This is consistent with practice in many European countries including Spain, Cyprus and the Czech Republic.

Why Albania for Egg Donation?

Albania offers a compelling combination of factors that make it one of Europe's preferred egg donation destinations: legal clarity, high-quality medical infrastructure, a large and screened donor pool, and significantly lower costs than Western European clinics. Waiting times for matched donors are typically 4–8 weeks — far shorter than in countries with stricter restrictions.

HealthFirst IVF manages the entire process — donor matching, legal documentation, clinical coordination and your stay in Tirana — as a seamless full package.
